Privacy notice
MidSquare Capital (Pty) Ltd is an authorised financial services provider (FSP number 53511) regulated by the Financial Sector Conduct Authority. This notice explains how we process personal information in terms of the Protection of Personal Information Act, 4 of 2013 (POPIA). It is drawn from the firm's Protection of Personal Information Policy, a copy of which may be requested by email to info@midsquare.io.
What personal information we collect. MidSquare is a responsible party in respect of the personal information you provide to us or which we collect from other sources. Depending on the nature of our business relationship with you, this may include identification documents, proof of address, tax and VAT registration numbers, classifications and disclosures under local and international tax laws (including FATCA and CRS), contact details, banking details, constitutional documents and registration details of legal entities, ownership structures, statements on source of wealth and source of funds, details of your investments and transactions, and website usage and other technical data.
Why we collect it. Certain categories of personal information are required by the Financial Intelligence Centre Act, 38 of 2001, similar anti money laundering laws in other jurisdictions, and the firm's Risk Management and Compliance Programme. We process personal information to establish and administer our legal relationship with you, to open and operate accounts with local and international providers, to comply with our legal and regulatory obligations, to render services under our agreement with you, to protect legitimate interests, and to communicate with you. Where personal information is not provided, we may be unable to continue a business relationship or provide certain services.
How it is processed and shared. Personal information may be processed and stored manually at our offices and electronically on our systems, and may be collected directly from you or from other lawful sources. It may be shared within the MidSquare group, with regulatory bodies and local and international tax authorities, and with third parties who perform services to us or in relation to your account, including brokerage, banking, custody, trading, insurance, administration, accounting, audit, client verification, cloud, data processing and payment services. Depending on our relationship with you, personal information may be transferred across borders as permitted under POPIA. When we share personal information we take appropriate, reasonable steps for its protection in line with applicable legal obligations.
How long we keep it. As a general rule we retain personal information in accordance with retention periods set out in applicable laws, unless a longer period is required for a lawful purpose such as complaints handling or legal proceedings. Cookies and analytics on this website. When you attest your investor category to access the gated area of this site, a cookie is set to record that attestation for your session. Website analytics run on a consent basis through Google Analytics 4 and are activated only if you consent; declining analytics does not affect your use of the site.
Your rights. You have the right to request access to the personal information we hold about you, to request that it be corrected or deleted, and to object to its processing. Requests may be sent to info@midsquare.io. If you wish to complain about how the firm has handled your personal information, contact us at the same address; the firm's Compliance Department, in consultation with the Information Officer, will contact you within two business days of the complaint being lodged and work with you to resolve the matter. If you consider that your complaint has not been adequately dealt with, you may contact the Information Regulator on 012 406 4818 or at inforeg@justice.gov.za.
